It is not an issue for people of Indian origin who are returning, of planning to return, back to India for whatever reason. They are the lucky (?) ones to have either a Indian passport or PIO card or OCI card so they are eligible to work on that basis.
But how about those who do not qualify for one of the above? There is an increasing number of foreigners working in India - how do they become eligible to work in India? Is there an equivalent of an H1B, or may be oneday GC & Citizenship?

The lizard is well exposed, but the composition bothers me some. Feels out of balance to the left because of the cactus. The flower & lily pads are very nice, but I really like the butterfly. Good subject isolation and vibrant color.

Well they could hurry up and approve my eb1-c that's been pending for 8 months despite them saying 4 is their target! I can't see how they can say not enough applications when they are way off their targets for poor souls like me. I've put in an SR so we'll see what happens

Hi,
I need advice on my situation. My wife filed EB2 based 485 application through her employer and my application and my son's application were filed as derivative applications. My priority date is Dec 2005 and country of chargeability is India. My application and my son's application were approved on August 04, 2010 but my wife's application is still pending approval. It has been nearly 10 days since derivative applications were approved.
I understand that derivative applications cannot be approved without primary application getting approved first but why, then, my wife's application is still showing "initial review"?
I am confused and getting a little worried about this. Any advice will be appreciated.

I believe what you need to show is the company's P&L statement with revenue statement, and not just $7000 in profit. if the company has a revenue of $1mil or more, it should be fine, if less then it needs to show how many employees it had and what profit or loss it made....it should be at least $1.0 profit, rather than a loss.

but if we look at the company NET CURRENT assit from schedule L in tax return
and then pro rate the wage for 7 month ( because company file the LC in JUne)

Hi All,
I have a strange issue, paining me since I have joined this new company, ( I am using AC21, since I am on EAD and AC21 is not yet filed). I am one of those unlucky fellows with really long name(First Name) stuck on my passport, and I have been using this all along, as my legal name while applying for visa/485 related activities. However, I go by the last part of the First Name and so all my other records here (like DL, SSN card, Bank Accounts, 401K account, etc) have got the last part of the First Name as my first name.My H1-B visa had the complete first name printed on it, and so I have been thinking, people could see that the name I have been using is in the last part of the complete First Name on the Visa and Passport.
However, in the EAD card, the name got cut(or incomplete) as the entire first name could not be printed on it. When I showed this to the new employer, they are using the name as displayed on the EAD card(which is not what I go by) in all the accounts they are establishing, like Paycheck, 401K info, ESPP etc.
Now I am in a soup, I have requested them to use the last part of the first name, which they are chcking with their immigration lawyers. But in the meanwhile, I want to know, does any one has this kind of problem. What should we do if the name is incomplete on the printed EAD card? (Ofcourse once I get GC, I would rather change this damn name)
Any one has any ideas?

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

No you are not required to file a separate petition for your husband. When your sister files the I-130, she needs to put your husband's name on the same form.
When you file DS-230, Each family member that is eligible to travel to the United States with you under this visa classification is required to complete the DS-230 Part I. So separate DS-230 are required for you and your husband.
1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;
D. Your married son or daughter of any age;
E. Your brother(s) or sister(s) (you must be age 21 or older);
F. Your mother or father (you must be age 21 or older).
If your relative qualifies under paragraph 1(C), 1(D), or 1(E) above, separate petitions are not required for his or her husband or wife or unmarried children under 21 years of age.

I am on AOS and currently working on my EAD. If I lose the job and employer terminates the health insurance, then will I qualify for the COBRA coverage or is it strictly for the Greencard/citizens? Any info is greatly helpful.

Thanks, Greenways. After seeing your post I called my attorney right away. The office assistant informed me that my 140 has been approved on August 27th 2008 and sent me a copy of the approval notice.:):):):):):):)
My dirty employer has been hiding this fact from me for the past two months. I have been waiting all these days, hoping that my I140 will be approved one day, checking case status almost daily etc. I am really really mad now. :mad::mad::mad::mad::mad::mad::mad::mad::mad::mad: :mad::mad::mad:
CRIS still shows that my case status as application received and pending, although there was a soft LUD on august 27th on my 140 application, which is the approval date of my 140. I failed to understand the meaning of the soft LUD at that time, but now I know. So, my dear friends, do not rely on CRIS for updates. Please check with your employer/attorney to get the latest status.

If you are efiling EAD, you dont have to send photo graphs - USCIS will send FP notice to take a picture. That picture will appear on your EAD.
It is required that you send photos for your ead as they put your picture on the actual ead card. I did not apply for AP so I am not sure about the requirements for that. Good luck to you.

I congratulate everybody for getting the opportunity to file 485.I am truely happy for u guys.
I am one of the very few people who can not apply for 485 as I have just changed my company and labour yet has to be filed.
I just wanted to to know Is it still possible that they will bring some kind of amendment(From CIR bill) which wouldn't allow me to extend my H1 Visa after 6 years?.I am so scared when I read on numberusa that some amendments are coming back to vote.Are we really in trouble?.
I just need some lodgical reasons that it won't happen.
I know everybody is busy but don't forget about people like us.
