    Guys,
    I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
    Any advices?

    If you have travelled to Canada in May even if you have a single entry visa into Canda, you are more likely to be let into canda than refused. On the way back if you ask they might issue you a new I-94, strictly speaking they don't have to unless you have stayed some period (I don't know the exact period) out side the country.

    Most parents coming to US on visitor visa and wanting to stay in us for more than 6 months apply for new I-94s(extension), just because attempting to cross the border does not give them a new I-94.

    Can't avoid anything that future hold for you.

    1. It would be good if the employer does not let USCIS know about your layoff.
    2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
    3. Hoping your employer does not revoke your I-140
    4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

    I talked to an attorney and he said that she can file but likelihood of getting another extension is very low.
    Talk to a competent attorney. Medical reasons are seen as EXCEPTIONAL cases by USCIS. If the illness is serious enough she will be given preferential treatment and might get visa waiver for the duration of her treatment. A proper attorney can advise further.

    Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!


    There are two ways :-

    a) Get your H1 transferred and join a new company. You need to complete your new PERM and I-140 before Mar'08 to get your next extension. In this case, you cannot carry over your PD.

    b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.

    There would be other ways too - folks here can enlighten you on the same and if there are any corrections in what I suggested you, they would gladly do it.

    EB3 is an overloaded ship, either you had to abandon(read porting to Eb2) or unload few of them (removing 245(i) cases from Eb3) to reach the target.
    Abandoning can take an year for most of us - PERM Approval time line for now.
    Unloading will never happen in this economic scenario
    So we had to look for lifeboat saving to do the miracle. If any one finds it let me know am ready to grab it.

    Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??

    Hi:

    Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

    Hello,

    My husband's been going through a tricky situation. He's working for a company that filed for his PERM and to renew his H1B after the 6th year.

    However, the situation now is:

    1) PERM process got audit

    2) H1B extension is still pending decision from the immigration

    3) Another company is interested in hiring my husband

    So my questions now are:

    1) Can my husband transfer his H1B visa to a new company even without the decision about his extension filed by his current company?

    2) What are the chances that they approve his H1B transfer, considering his renewal beyond 6 years is still pending decision and the PERM got audited?

    3) If everything is possible, how long after transferring to the new company can the current company keep his PERM process going?

    4) What are the chances he get an extension for the 8th year if the new company apply for his PERM immediately after his HI1B visa transfer approved?

    Last October I hired a lawyer for an AOS ( I-485 ) and the I-130 and I-131 forms.
    Obviously I did it because I did not have any knowledge about immigration matters.
    In Novembre 2007 he did contact me telling me I needed the I-765 form to legally work in the country, so I did fill the form sending it in his office by mail.
    He told me he sent the form in the first week of December 2007.
    Ok now this is the situation :
    I never get by mail the notice of action about the form I-765 and what concern me the most is that I still did not get the permit to work.
    I periodically check the processing time cases from the USCIS' website, and I have seen that USCIS (NEW YORK area ) already processed the I-765 forms for the complete month of December, does anyone know if Uscis is having problem processing EADs....I am really worried that something did not go through... probably it's just normal to have so many questions but recently I think about that all the time.
    Oh guys one more thing...I paid this lawyer thousand and thousand of dollars.
    I realized reading the USCIS website that if you fill the form I-485 you are not required to pay the $ 340 fee for the I-765 form . Last November he asked me to send him a check for the EAD fee. When I told him that last time i spoke with him by phone he said he did know that , then he told me that he just had moved from his old office to a new one so my case was in storage, in storage ?? My case is still pending and he put it in storage, i am so disappointed ...unbelievable this lack of professionality.
    I should have do it by myself at least now I would have money to buy a nice used car.

    The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

    Pls. google USCIS pages for official info. You cannot stay for more than 6 months away from US each year every year. The situation might be different if its a US based company abroad.

    US rolls out new online visa form in India

    NEW DELHI - With the demand for US visas surging by the day, the US embassy and its consulates in India have introduced a new online non-immigrant visa (NIV) application form to cut out needless delays.


    The DS-160 form will be online on the website of the US embassy from Jan 19. For all NIV visa appointments starting Feb 1, applicants will need to fill out the DS-160 form, the US embassy said here Wednesday while announcing the introduction of the new form.

    The new form, that leverages new technologies, is expected to cut processing delays as applications could be pre-processed and pre-screened before an applicants interview.

    Applicants will continue to complete visa application forms online, as they did previously with the Electronic Visa Application Form, the embassy said.

    The demand for American visas has been escalating in India over the years.

    The four US consulates in the country had processed 725,000 visas in 2007 - a 58 percent increase from 2006.

    India is among the top 10 countries sending visitors to the US.
