You can use EAD with current employer. I think your company has to do the change your I9 form to EAD. You don't need to inform as you are not changing any company.

My H1 is valid until 2010 Feb.
I am also having EAD till 2011 June.
I have been with my employer all along.... and prefer to stay with same employer till GC.
I DONT want to apply for my H1 extension since they are asking lot of questions like Contract details etc with RFE's.
My Q is - Can i use EAD with my EXISTING employer or EAD should be used for only NEW employer based on AC21?
If i use EAD with my current employer, should i have to inform uscis(any process involved)?
Please suggest...

I read a few of the comments and quickly realized that its just trash
I refuse to post a comment when the caliber of people commenting on there is so low that they will gain nothing from my comments and only possibly use it to spread more hatred.
All they are doing is openly showing that they have no intelligence and are not worth the attention they get.
Why bother to comment when they can't finish a proper sentence without abusing. I got better things to do.

Yes, I realize a H1 transfer is needed to work in another company. And 140 is not approved. So the new company has to start GC all over. Too bad, it looks like priority date cannot be ported since it LC is still in process.

My employer let me signed 3 contracts. First was for the year 2006 then two for 2007. They said they just changed a few things but it is the same. The previous two contracts said if ever employment is terminated prior to an agreed date, reimbursement to the employer will be pro-rated. The 3rd contract was changed to reimbursing the employer the full amount of the contract which means H1B fees, recruitment fees, sign-on bonus and reimbursement. I was not aware that they've changed the reimbursement because I did not read the third contract anymore because they said it's the same.
Is it legal for the employer to charge the H1B employee the H1B fees, recruitment fee, sign-on bonus and reimbursements? I applied directly to my employer but they hired a recruiter and was just made aware of the huge amount after working for 3mos with them. They never gave me a copy of the total amount of my contract until I asked for it.
They filed for my I-140. It was already approved and just waiting for the I-485 to be filed.

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

- H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
- You may have issues with 140 approval (Just my opinion, I may be wrong)
- If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

Hello,
I got here on K-1 visa on 05/03/2010. Got married 07/03/2010. Got my SSN and applied for I-485, I-765 within the timeline. Received RFE for co-sponsor as my wife's salary wasn't enough. Her dad was suppose to do it but stepped back. When we filed I 485 & I 765 we also sent the I864A form which is a contract between the household member and the sponsor. But now we did not send it cuz we have moved out. She lost her job just one day before we responded to RFE but we still sent her work documents cuz they were already in motion as when we applied for it we sent her work info. My friend co-sponsored and we responded to RFE within the timeline. Received an update that the decesion will be made in 60 days. Not sure they will approve it because my co-sponsor's salary is only $24,000 per annum. The question is, if they deny then we will apply for MTR and they deny that too then do I have to leave from USA because I can't leave my wife like that cuz she has nobody after me here as she already got seperated from her family too as I did. We are very young. I am 23 and she is 19. We got married to have a dream to live together forever. I can't take her back with me to India cuz she is highly lactose intolerance person, doctors said she might die if she goes there cuz our food is 99% dairy. Please help...

If not EB1, even EB2 is fine because you belong to UK and EB2 is current for you. If you claim EB1, you can easily apply in EB2 and it's "current" for you.

I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?
Please let me know.
When did your I94 expired?
Even though it expired and if you are having a EAD you are legal.
Your H1B visa is still valid. If you want you can reenter using the same H1B Visa.
All you need is to extend your stay. I think you can do it by contacting CBP office in your area.

I am having the same issue.Applied AP online on 1/10/11.Got receipt no and Application as PDF.I have the Receipt no and sent all supporting document with LINXXXXXXXX no.But I have been trying to add the case no to my profile and it says not found.I am not sure what can I do or wait for more days.

I am in the same situation. I have already sent my FOIA request about 3 weeks back. They have processed only 250 request in last one week. They have around 8600 requests. So it will take around 7 to 9 months to get the docs.
Since you will be asking only for I-140 and/or perm docs, there will be no cost.
You need to know SOC code/Job responsibilities/Salary for using AC-21.
Hopefully, some one who has more knowledge will reply to your other questions.
