Thanks for reading this message. Since you are from mid-west, you are capable of taking your car and drive in the direction of DC. It will take anywhere from 9-15hours. But you will be able to do it.
If there was a possibility of USCIS handing a GC in person, you would have driven 50 hours. Can you not drive for 10hours for a cause that is affecting you, me and everyone around us?
Now make up your mind and drive and meet other mid-westerners in DC.
I know one mr Gan*** - who flew to Nebraska with a Substitute labor and i 140 petition on the last day before labor substitution was banned. Mr Gane** also filed for 485 after the fiasco and we had a drink together because he thought he did a marvellous job as he is just 2 months old in US and has just landed in a consulting job and already applied 140/485 during the fiasco.
But he is not willing to hop onto my car, lives 5 miles from my place in Queens, to go to DC.
This shows the poor attitude people have towards grassroots efforts.

I went to Infopass to enquire about my interfile status. The first level officer said since my PD is not current, she will not allow me to meet the IO. I argued that PD has nothing to do with knowing the status and allow me to meet the actual IO. she still did not. What a crap !!!

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
I probably go ahead and use what in the approved labor certificate. by the way how do I find exact job-code that I used in the I-140.

My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July.

Since she got H1 status first time in Nov 2004, she can have H1 transfer without quota only until Nov 2010. After that her H4-to-H1 will be subject to cap.

Hello,
My husband's been going through a tricky situation. He's working for a company that filed for his PERM and to renew his H1B after the 6th year.
However, the situation now is:
1) PERM process got audit
2) H1B extension is still pending decision from the immigration
3) Another company is interested in hiring my husband
So my questions now are:
1) Can my husband transfer his H1B visa to a new company even without the decision about his extension filed by his current company?
2) What are the chances that they approve his H1B transfer, considering his renewal beyond 6 years is still pending decision and the PERM got audited?
3) If everything is possible, how long after transferring to the new company can the current company keep his PERM process going?
4) What are the chances he get an extension for the 8th year if the new company apply for his PERM immediately after his HI1B visa transfer approved?

I had a similar issue during my first H1B visa stamping. My H1B was approved from company ABC and after approval name of the company was changed to XYZ. So, my employer gave me copy of a letter issued by State of Maine (Company ABC was registered in Maine). This letter stated that company XYZ is same as ABC. My passport was stamped with company ABC's name. My employer also gave me a letter stating that XYZ is same as ABC.
Not sure how this name change will affect your I-140 or I-485.

People who get labor approved in August, can they avail current window provided by USCIS and concurrently file 140/485?

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....
Hope this story helps.

I am on H-1 and recently filed for my 485. After I receive an EAD in 6 or so months, am I eligible to go to school full-time while waiting for processing on my 485 application?
To continue your 485 processing, you should either join another company with a similar job or you should be able to join your existing employer once the I-485 is approved.

You can go to any industry financial, insurance, pharma etc but your job and duties should be similar to your current one. If your current position is *mathematician* and your new job says "consultant" it will catch the officer's attension easily. But from other threads in understood that your job description should be similar to your current ones. Please go thru some IV threads.

Just a side note,you should send EAD/AP renewal applications only 120 days in advance not 180 days..according to the new rule set by USCIS.
