I am just curious to know that did any one get the interview call for green card after replying to RFE.
My wife and I received the RFE last month to which we replied. The USCIS have received the reply and have updated the status saying that i should expect to get the response from them in 60 days. I am not sure what response they are talkign about because i am not current and i dotn expect to be current in Oct. Any clue?
I know many ppl. got the interview call...but i am not sure if they receive the interview call after replyign to RFE.
Is it a possibility that if USCIS sends the RFE then the chances of getting the interview gets slim. Please ADVISE !!!!

Please use "Ask a lawyer for Free" link to get response from lawyer. More than 60% users of this site does not have GC and they can not advice because they never get chance to marry US citizen...Thanks.

Many threads here are on this, you've got to look for it and read. You've asked a question that has been asked and answered many times. That is why nobody has answered your questions.
In brief, you can use AP to come back, and work with H1B for the company who filed your H1B petition, and you can extend or transfer your H1B as well. You can also work on EAD for anyone you want, but you cannot come back to H1B.
There is more on other threads that will make you feel more positive about these answers, and helpful info on traval with AP.

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

Hi,
My 6th year H1 expires in Feb'07 and company is ready to apply 7th year extension using premium processing. Assuming I get H1 extended by Oct 1st and travel to India in Nov for 2 weeks, is there a problem in coming back with old visa.
Since the appointments are full for the next 6 months I don't have any realistic chance of getting new stamping done during the trip. I know traveling while extension is pending is a big NO NO but if extension is approved am I allowed to use the old visa stamp?

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all)
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?
EB2, if your I-140 approval reads as "Section: Mem of Profession w/Adv Deg, or of Exceptn'l Ability Sec.203(b) (2)" You should be worried only if you had two different 140 with the same employer. Take infopass and give a try, there is no standard procedure to find out.

I believe a majority of those problems are for H1-B's that are consultants and move around on different projects. In your case it appears like you have a stable and consistent role given that you have been with the same employer for so long. Hope this helps.

I married to a US citizen and got conditional permanent residency which is subject to be removed after 2 years. I have been a student at a university, and while an application for permanent residency I had to show/combine my income (student teaching/research assistantship) in I-864 because my spouse's income was not sufficient to sponsor me. In form I-864 instructions it says, "Intending immigrant is your spouse, his/her income can be used to combine with your income if his/her income will continue from the same source after receiving lawful permanent residency." Now, my question is that I have an offer of admission from other school, and this new school will pay me student teaching/research assistantship, can I leave my current school and join the new one? If not, how long I have to wait in order to have right to change my school?
Secondly, can my spouse leave her job and sit idle? I ask this because my spouse sponsored me in I-864, and I wonder until when she is supposed to continue her current job!
Please advise me your best to help me with my doubts. I will be obliged!

If I don't use a compliant marriage broker to meet my fiance, then my K1 visa gets denied, automatically, because I met via a "black market" broker, for lack of a better term.
Is that true, or is he just trying to scare me into using HIS service? I've read the ENTIRE text of the International Marriage Broker Regulation Act (it's not a very big statute to read; it's a subsection of a much larger act), and it never says anything about how I should get denied to sponsor my fiance's visa because my BROKER didn't conduct the background checks.
I wouldn't be this concerned if it weren't for the fact that there are very few sites that seem to comply with IMBRA's criminal background check regulations. I have no problem telling the woman that I'm not a criminal (I've got nothing to hide), but why should I be denied the right to marry her, forever and ever, with no recourse, since the damage has already been done, because my BROKER messed up?
The only negative consequence I've read in this act is that the broker has to pay a fine if he doesn't conduct the background checks. Whoopdie doo! What does that have to do with me?! As long as I get the visa for my soul mate, I could care less what happens to my broker; he's done his job as far as I'm concerned.

Hello everyone,
It is extremely unfortunate but I have lost my green card. I can�t seem to find it anywhere. I know that it has not been stolen, just lost! I need to apply for a replacement green card ASAP. I need to submit some initial documents along with my I-90 form for it. I have been trying to search on the internet regarding it but I can�t seem to find a clear answer.
Long story short, could somebody please tell me what initial documents are there to submit along with my I-90 form? I have a copy of my original green card, but is there anything else required? Am I required to submit my photos along with my form?
I would highly appreciate if someone could reply to my queries ASAP.

I have a original copy whereas the lawyer has the approved I140.
Should I ask for the original or is that copy good enough?
This is taken from the 495 instructions:
Evidence of eligibility.
Based on an immigrant petition.
Attach a copy of the approval notice for an immigrant petition that makes a visa number immediately available to you, or submit a complete relative,special immigrant juvenile, or special immigrant military petition which, if approved, will make a visa number immediately available to you.
You do not need the original at all. It is property of the employer.

My Personal experience was:
- When my H1B was filed for the first time it had a wrong Date of Birth, lawyer asked me to bring Birth Certificate to the Interview at the consulate. I did not have problems with the stamping of the visa.
When my extension was filed , again, Date of Birth was wrong. Lawyer told me the same thing. Get recent Birth Certificate and bring it to the Interview.
Did not have any problem at all.

It's an XNA application, but I just can't seem to find how to just open a socket, and wait for the server to send me some data, and have a callback handle that data...

My fiances parents are applying for a B1/B2 Tourist visa on the basis of her 2 graduation ceremonies. We will get married in a court before her parents apply for a visa but the marriage ceremony will be between 2 graduations in US. If we also show that her parents are attending daughters wedding ceremony in US will the likelihood of them getting a visa increase? We can send a copy of marriage certificate before parents visa interview.

I don't think so. The VO is interested in ensuring that your in-laws are visiting US for tourism / family visit and will return back after the visit. VO also wants to ensure that someone will pay for the entire trip and they will not become public burden.
