    My new employer doesn't sponsors/transfers H1B visa. And my priority date is Dec 04 EB3 so I don't think that I would be getting my GC in near future!

    As per the job I know this one is the safest since the new employer has never ever laid off employees in its entire history. So, I'm not worried about the job security, only thing which scares me is that if there is some problem in my I-485 and I get a denial whether I would be able to switch back to H1B?

    Worst case scenario my wife has a valid H1B and I can switch to H4 and probably wind up the things here :-)

    I came to the US on F1 for MS and then trasferred to another college to pursue my PhD. During this time my F1 visa expired, but I am maintaining my legal status as my I-20 is valid. I got married last year and my wife who originally came on F1, is now on H1.
    I am going to planning to go to India in end of April and need to renew my F1 visa. What are the chances of my renewal getting refused, due to my wife's H1 (dual intention) status? What documents if any, can I show in order to prove that I have intentions to come back to the US?
    I need to get a visa interview date soon, so please reply as soon as is convenient.

    Hi everyone,

    Here is my situation and I need URGENT help.

    I am currently on L1-A for past 7 years (Visa expires Nov 07). During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.

    I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?

    Please reply urgently if anyone has the answer to my question as I am running out of time.

    I have been noticing a lot of people moving changing jobs using EAD. Especially a lot of June and July 2007 filers.

    The time to renew EAD is approaching and I am sure there is going to be a surge in EAD renewals.

    There was also a recent communication from USCIS that one must not apply for renewal prior to 120 days of their EAD expiry date.

    In past has anyone been in a situation where they are not able to renew EAD in time and how you handled it?

    Do you plan to apply for EAD exactly in the 120 day range to make best use of time? What if EAD renewal gets severly backlogged?

    I think this is something we must all concentrate on and try to get some answers from USCIS on this as it will help planning.

    Hi ,
    Does it impact I140 processing if i am outside US and worked with same employer in India ?
    I have left for india assignment after concurrent filing (I 485 + I 140)
    for 4 weeks and joined back in US for different assignment last year after July filings.
    But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.

    Has any one experienced similar situation ?
    Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
    Can anyone advise ?

    The government has been ramping up enforcement of employment immigration laws, with a particular focus on insuring that companies are staying in compliance. The number of enforcement activities has increased dramatically in the past year. Now, more than ever, it�s important to insure that your company is ready in case of a government I-9 audit. And for the first time, it�s not enough to be in compliance. Each company must prove compliance, and if using an electronic system, use one that works in accordance with immigration laws.

    The San Diego Union Tribune reports (http://signonsandiego.com/news/2010/oct/09/immigration-audits-are-increasing-against/), enforcement in San Diego County mirrors a national trend toward more scrutiny of employers� I-9 forms, the universal tool for verifying permission to work in the United States.

    Immigration and Customs Enforcement, or ICE, initiated 66 audits with local employers in the fiscal year ending Sept. 30, reviewing 5,588 individual I-9s in the process. That was up from 44 audits in fiscal 2009 and just one audit in 2008. A company can be fined up to $1,100 for each illegal employee, and knowingly violating verification laws can lead to criminal charges and forfeited assets.

    So the heat is now on employers to clean the house, it is also a great burden on employees to find work. As the illegal population continues to grow, they will also find creative ways to deal with the system. All we can suggest employers is to conduct routine internal I-9 audits and have an immigration policy in place, this is the best practice to follow.

    I live in GA. My 485 was filed at NSC and was receipted at CSC and transferred back to NSC.

    As per the filing instructions, I will have to file EAD at Texas Service Center.
    But some folks told me to file at the location where I-485 is pending.

    I have the following questions

    a> Where should I file my EAD renewal
    b> Is it true, paper based EAD renewal does not require finger printing

    Yes you don't need finger printing for paper based EAD renewal.

    It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.

    I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)

    For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.
